A victory on the Rhode?

In June, Hailey Bieber made news when she unveiled her much awaited skincare brand, Rhode. However, the launch was delayed when a competitor with the same name filed a lawsuit against the model for trademark infringement.

An first decision in Justin Bieber’s favour has now been reached by a judge: According to E! News, the plaintiffs’ side filed an emergency letter motion on July 22 in relation to the “The Making of Rhode” YouTube documentary that the celebrity debuted the same day.

After watching the video, the judge “denied the group’s motion for a preliminary injunction without prejudice,” allowing Bieber to release the video (and keep promoting her brand) while the litigation is ongoing.

In the 17-minute video, Bieber discusses the meaning behind the name of her beauty business, which is also her middle name.

The legal team supporting fashion business Rhode alleged in a previous statement to Web page Six Type that Bieber attempted to acquire the trademark from designers Purna Khatau and Phoebe Vickers in 2018 before launching her brand anyhow in 2022 when they refused.

A consultant for the designers informed us on Monday that “Our litigation is still pending. The court’s decision just delays the decision until we have the time to gather further evidence, allowing Hailey Bieber’s skincare line to continue using our brand name while the legal action is still pending. We expected this outcome since it’s extremely unusual for a judge to challenge the preliminary order we requested.

We continue to be confident that we will prevail at trial, they added. We created the name and model “Rhode,” which is protected by both federal and state laws. We want Hailey to achieve her goals without using the brand name we have worked so hard to build over the past nine years.

“We’re pleased with the court’s detailed judgement dismissing plaintiff’s motion to preliminarily enjoin Hailey’s new company and skincare brand,” Michael Rhodes, Bieber’s family attorney, told us.
